Tyler is a Technology, Privacy and Cyber Lawyer (and hobbyist software developer) based in New South Wales, Australia.
Tyler has acted for many of Australia’s most recognisable technology organisations in matters centered around technology contracting/procurement, cyber incident response, privacy preparedness and contentious disputes.

Transactional and Advisory

Lead counsel on channel partnership agreements and corporate/business structuring with prominent global accounting and HR software vendor.

Producing bespoke Subscription Software Development Agreement for the sale of an in-development Property & Rating Solution aimed at the local council market based on a modified ‘waterfall’ development methodology.

Producing incident response policy framework/guide and preparedness documentation for not-for-profit community legal organisation in New South Wales.

Cyber Incident Response and Privacy

Advising multiple Australian organisations on incident response best-practice and compliance with the Notifiable Data Breach scheme in Part IIIC of the Privacy Act 1988 (Cth).

Advising ASX-listed and multinational civil engineering/construction company on cross-jurisdictional data breach involving data from Australian and New Zealand data subjects.

Assisting large Australian organisation and government contractor to review and analyse detailed digital forensic evidence in response to ransomware incident with potential to impact government databases.

Leading data review of ASX-listed organisation in high-profile breach of hundreds-of-thousands of financial documents to identify and shortlist eligible individuals for notification using modern data science tools like Python’s Pandas library and Jupyter Labs.

Advising Australian state-government contractor on the complex exemption structure in the Privacy Act 1988 (Cth) for state government contractors, and obligations under state privacy regulations in response to public database exposure incident.

Advising organisations on responses to requests for information (RFIs) made by the Office of the Australian Information Commissioner (OAIC) following notification of an Eligible Data Breach.

Advising ASX-listed company on significant review of expert digital forensic evidence within the context of a large-scale ransomware incident.
Insurance
- Advising underwriters (insurers) on settlement for cyber insurance claim involving over $1 million of claimed IT services which were contentious under the policy wording, resulting in agreed settlement.
Contentious Disputes

Defending a school in New South Wales from a privacy complaint launched in the Office of the Australian Information Commissioner (OAIC) alleging serious breaches of privacy arising from alleged sharing amongst students/teachers of photos depicting intimate acts, resulting in successful dismissal of the complaint.

Advising leading Australian business software company on a successful settlement outcome involving alleged liability arising from ransomware cyber incident.
